Listing terms
The terms for private owners, brokers and franchisors who list a business or franchise opportunity on BizExchange.
Last updated
These terms apply when you list on BizExchange, and they add to the terms of use. "You" means the person or business listing, and for a brokerage or franchise brand, everyone on its team.
Who may list
- Private owners may list a business they own, or are authorised by its owner to sell.
- Brokers and agencies may list businesses they are appointed to sell. You must hold any licence your state or territory requires to act as a business agent.
- Franchisors may list franchise opportunities for their own brand. Franchise opportunities can be listed only from a franchisor account, and always show that franchisor's brand.
- List each business once.
- The owners of a brokerage or brand invite their team. Owners manage the profile, billing and feeds; other team members manage listings and see enquiries. Owners are responsible for their team's listings.
How a listing goes live
- Private owners enter the listing, add photos, choose a plan and pay through Stripe. The listing stays a draft until payment is complete, then goes to review.
- Brokers and franchisors add listings by hand, by uploading a CSV, JSON or REAXML file, or by connecting a feed from their listing software. An upload shows you every change before anything is saved. New listings go to review. Changes, withdrawals and sales from your uploads and feeds apply straight away, and a live listing that drops out of your feed is withdrawn once it has been missing from two feed runs. A new feed starts in review mode, where new listings from it wait for our review; after a good first run we may switch it to publish new listings straight away.
- Review. We check every new listing within one business day. We may approve it, send it back to you with changes to make, or not publish it.
Broker listings from public sources
BizExchange may show a short factual summary of a business that a broker advertises publicly elsewhere:
- The summary uses only facts: the industry, location, asking price and the figures the broker published. We do not publish the broker's description or photos.
- The broker is named on every one, with a statement that enquiries go to the broker and that the figures are as published by the broker and have not been verified by BizExchange.
- Enquiries are emailed to the address the broker published with the original listing. Each email has a link to claim the listing for free and a link to remove it, with no login needed.
- We check the original listing about once a week. If it has been taken down, is marked sold or under offer, or cannot be reached, our listing stops showing.
- Claiming. Sign in with the email address the enquiry was sent to and the claim is approved straight away. Claiming is free. You can then correct the listing, add photos, pause it or remove it.
- Claiming a brokerage. If you set up a brokerage that is already shown on BizExchange, the request is approved straight away when your email address uses the brokerage's own domain. Otherwise our team reviews it, within one business day.
- Removing. See the takedown policy.
Your responsibilities
- Everything in your listing must be accurate, current and not misleading, including the asking price, turnover, profit, stock, lease details and what is included in the sale.
- Label profit correctly as net profit, EBITDA or owner's benefit. Buyers compare listings on these figures.
- You must have the right to publish everything in the listing, including its photos and text.
- Keep the listing up to date. Mark it sold, pause it or withdraw it as soon as the business is no longer available.
- Answer enquiries yourself. Use buyers' details only for the sale, and handle them as privacy law requires.
- You are responsible for following the laws that apply to advertising and selling a business, including the Australian Consumer Law and the licensing and disclosure rules in your state or territory.
What you must not list
- A business or opportunity that is not genuinely for sale, or that you are not entitled to sell.
- Anything that is not a business or franchise opportunity, such as a job, or property or equipment sold on its own.
- An illegal business, or illegal goods or services.
- Anything false, misleading, defamatory, discriminatory or offensive.
- Personal information about other people, such as staff or customers, without their consent.
- Photos or text you do not have the right to use.
Plans and fees
Prices are in Australian dollars and include GST. Current prices are always on the pricing page. Buyers never pay, and we never take a commission on a sale.
Private owners
- 90-day listing, $149. Live for 90 days, checked within one business day, unlimited enquiries.
- Until sold, $299. Stays live until you mark it sold, for up to 12 months. Everything in the 90-day listing.
- Renew for 90 days, $79. Put an expired listing back up for another 90 days, with no new review.
- Featured for 30 days, $49. Shown first in its industry and state, and on the home page, for 30 days.
You pay when you submit the listing. We email you 14 days and 3 days before it expires. When it expires it comes off the site, and you can renew it from your dashboard.
Brokers and agencies
- All your listings, free. Unlimited listings: claim the ones already shown under your name, add your own by hand or from a spreadsheet, or connect a feed from your listing software. Enquiries go straight to your agents.
- Spotlight, $99 a month. Three 30-day featured listings every month (worth $147), and your brokerage listed first in the broker directory.
- Agency, $199 a month. Eight 30-day featured listings every month (worth $392), and your brokerage listed first in the broker directory.
Listings are free and unlimited for brokerages on every plan, including feeds. Paid plans are billed monthly through Stripe and add featured listings each month; featured listings not used in a calendar month do not carry over. A single listing can also be featured for 30 days for $49.
Franchisors
- Profile only, free. Your franchise profile, with no opportunity listings.
- One opportunity, $99 a month. Your franchise profile and one opportunity listing.
- Up to ten opportunities, $199 a month. Your franchise profile and up to ten opportunity listings, for example by region.
Plans are billed monthly through Stripe.
Changing or cancelling a plan
- Only an owner of the brokerage or brand can change billing, from the Billing tab in the dashboard.
- You can change plans at any time. Stripe adjusts the charge for the rest of the billing month.
- You can cancel at any time. The plan continues to the end of the period you have paid for, then ends. Until then you can keep it with one click.
- Brokerage listings are never paused for billing reasons: if a broker plan ends, the listings stay up and only the monthly featured listings stop.
- If a smaller plan or a cancellation leaves a franchisor with more opportunity listings than its plan allows, it has 30 days to choose a bigger plan. After that, listings in review go back to drafts and the newest live listings are paused until it is within the limit. We email the owners when this happens. Nothing is deleted.
- If a payment fails, Stripe tries again over the next few days and we email the owners. Your plan stays in place while Stripe retries. Update your card from the Billing tab.
Invoices and refunds
- Stripe creates an invoice for every payment. Owners of a brokerage or brand can see past invoices through the Billing tab.
- If we do not publish your listing at review and you do not resubmit it, we refund the listing fee in full.
- Once a listing is live, its fee is not refundable, except where the Australian Consumer Law gives you a right to a remedy.
- A featured upgrade is not refundable once it has started.
- Cancelling a monthly plan stops future payments. We do not refund part of a month.
- To ask about a refund, email support@bizexchange.com.au. Refunds are paid back through Stripe to the card you used.
If we change our prices, the new prices apply to new purchases. A listing period you have already paid for is not affected.
What you allow us to do with your listing
- Publish it on BizExchange: on its own page, in search, category and franchise pages, on the map, in the weekly newsletter and in saved-search alerts, and in search engines.
- Format your photos and text so they display well on the site and in emails.
- Show its location on the map at the centre of its suburb, never at the business's address, or at the centre of its region if you keep the suburb confidential.
- Use its figures, and any sale price you choose to report, in the BizExchange Asking Price Report and its downloadable data, which are published under the CC BY 4.0 licence. The report shows only medians and counts, and any figure based on fewer than 20 listings is withheld, so no individual listing can be picked out.
This permission ends when the listing comes off the site, except for report figures already published and emails already sent.
Our right to decline, pause or remove a listing
We may decline, pause, hide or remove a listing, or suspend an account, if:
- it breaks these terms or the terms of use;
- we reasonably believe it is inaccurate, misleading or unlawful, including after a report from a buyer or anyone else;
- it has not been paid for, or your plan no longer covers it after the grace period above;
- it is a listing from a public source and the original is no longer available; or
- someone entitled to ask for its removal asks us to remove it.
Owner listings also come off the site when they expire. A listing marked sold shows as sold for 30 days, then comes off the site.
Enquiries, results and liability
- We deliver enquiries to the contact on your listing. We do not promise any number of enquiries, a buyer or a sale, and we are not responsible for what buyers say or do.
- Our services come with guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these terms excludes, restricts or changes any right or remedy you have under that law. The liability limits in the terms of use apply to listings too.
