Terms of use
The rules for using BizExchange, whether you are buying, selling or just looking.
Last updated
These terms apply when you use BizExchange (www.bizexchange.com.au). By using the site you agree to them. If you list a business or franchise opportunity, the listing terms also apply. How we handle personal information is set out in the privacy policy.
What BizExchange is
- BizExchange is an online marketplace. Private owners, business brokers and franchisors advertise businesses and franchise opportunities for sale, and buyers contact them through the site.
- We are not a broker, agent or adviser. We do not act for buyers or sellers, negotiate, hold money for a sale, or take part in any sale. Any sale is between the buyer and the seller.
- Buyers never pay to use BizExchange, and we never take a commission on a sale. Sellers pay a listing fee or a monthly plan, as shown on the pricing page.
Your account
- You need an account to save listings and searches and to list a business. You sign in with a link we email to you, or with Google.
- Use an email address that is yours, and keep your email account secure: anyone who can open your email can sign in as you.
- You are responsible for what is done through your account. If you think someone else has used it, email support@bizexchange.com.au.
- The owners of a brokerage or franchise brand decide who is on its team and what each person can do.
Enquiries and contact with sellers
- An enquiry sends your name, email address, phone number (if you give it) and message to the seller. The seller replies to you directly, and we take no part in the conversation after that.
- Enquire only about businesses you are genuinely interested in. Do not send advertising, spam or anything abusive.
- Use contact details you receive through BizExchange only for the business they relate to.
- Requests for a confidentiality agreement or for finance options are passed to the seller. What happens next is between you and the seller.
- We do not promise that a seller will reply, that a business is still available, or that a sale will happen.
Information on the site
- Listings are written by owners, brokers and franchisors, or summarise what a broker has published elsewhere. We check new listings before they go live, but we do not verify listing details unless a listing says so.
- Guides, tools and the BizExchange Asking Price Report are general information. They are not legal, tax, financial or valuation advice. See the disclaimer.
- Check everything for yourself, and get advice from an accountant and a solicitor before you buy or sell a business.
Rules for using the site
When you use BizExchange, do not:
- post or send anything false, misleading, unlawful, defamatory, discriminatory or offensive;
- use the site to send spam or to collect other people's contact details;
- pretend to be someone else, or use someone else's account;
- try to get around our rate limits, spam checks or access controls, or try to see information that is not yours;
- interfere with the site or its security, or overload it.
Newsletter and alerts
The newsletter is a weekly email of new listings in the industries and states you choose, sent only after you confirm your subscription. Alerts for a saved search arrive as soon as a match is listed, daily or weekly, as you choose. You can unsubscribe from the newsletter, or stop alerts for a search, with one click from any of these emails.
Our content and yours
- The site's design, text and guides belong to the operator of BizExchange. Do not copy or republish them without permission, except as the law allows.
- Figures and downloads from the BizExchange Asking Price Report are published under the CC BY 4.0 licence, so you can reuse them with credit. See the methodology.
- Listings belong to the people who supplied them. The listing terms set out what they allow us to do with them.
Links to other websites
We link to official sources, broker and franchisor websites and other sites. We do not control those sites and are not responsible for what they contain.
Changes, suspension and availability
- We may change, add or remove features of the site.
- We may update these terms. The date at the top shows when they last changed. If you keep using the site after a change, the new terms apply.
- We may suspend or close an account, or remove content, that breaks these terms or the law.
- We work to keep the site running, but we cannot promise it will always be available or free of errors.
Your rights under the Australian Consumer Law
Our services come with guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that, and to the extent the law allows:
- we are not responsible for the accuracy of listings, or for anything a seller, broker, franchisor or buyer says or does;
- we are not responsible for the outcome of any negotiation or sale, or for decisions you make relying on the site's guides, tools or figures;
- we are not liable for loss of profit or any indirect or consequential loss;
- where the law lets us limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the services again, or paying the cost of having them supplied again.
